Element X has drafted this Privacy Statement to transparently inform Users about the website hosted at the following address:
www.elementx.travel (hereinafter the "Site"), and the way personal data is collected and processed by Element X.
The term "User" refers to any individual or legal entity that visits the Site or communicates with the Site in any way.
As the Data Controller, Element X determines all technical, legal, and organizational means and purposes for processing Users’ personal data. Element X commits to taking all necessary measures to ensure that the processing of personal data complies with:
The Belgian Law of 30 July 2018 on the protection of natural persons with regard to the processing of personal data (hereinafter the "Law"), and
Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, repealing Directive 95/46/EC (i.e., the General Data Protection Regulation (GDPR); hereinafter the "Regulation").
Element X is free to choose a natural or legal person to process Users’ personal data on its behalf (hereinafter the "Processor" or "Subcontractor"). In such cases, Element X commits to selecting a Processor that provides sufficient guarantees regarding the technical and organizational measures for processing personal data, in accordance with the Law and the Regulation.
2. Processing of personal data
Users’ use of the Site may result in the collection of personal data. The processing of this data by Element X, as Data Controller, or by service providers acting on behalf of Element X, is carried out in accordance with the Law and the Regulation.
Personal data is processed by Element X for the purposes below and through the following methods:
Web Forms: Element X primarily processes your data after you have filled out our web forms.
Correspondence: We also process data provided to us via correspondence, email, or telephone.
Element X may also receive personal data from other sources, such as:
Public Sources: Official government publications (e.g., Belgian Official Gazette, Crossroads Bank for Enterprises).
External Providers: Services such as Trendstop and Bizzy for the purchase of business contact information and for the unique identification, validation, and linking of personal data.
Advertisers and Social Media: Data collected through advertisements or social media platforms.
3. Purpose of personal data processing
In accordance with Article 13 of the Regulation, the purposes of personal data processing are communicated to the User. These purposes include:
Contractual obligations:
Personal data is primarily used in the context of a (potential) contract with Element X. This includes, among other things, administration, invoicing, handling complaints, and providing services related to the contract.
Inquiries and follow-up:
Data is processed to respond to and follow up on inquiries submitted through the contact form on our website.
Complaint handling:
We process data to handle consumer complaints submitted through the complaint form on the website.
Newsletters and information:
If no contract exists with Element X, we may use your personal data to send newsletters or information about our activities, provided you have given explicit consent. In such cases, you can always withdraw your consent.
CRM System:
If no contract or prior relationship exists with Element X, we may store your data in our CRM system to facilitate future communication or relationship development.
Technical functioning of the website:
We use personal data to ensure the technical functioning of our web portal. By visiting our website, you consent to the processing of your data for these technical purposes.
4. Personal data that may be processed
The user agrees that Element X may collect and process the following personal data during their visit to and use of the Site:
Name, first name, address (such as street name, house number, PO box, postal code, city/municipality, country), contact details (e.g., email address, phone number, fax number, mobile number), delivery address, account number, and KBO and/or VAT number.
Element X collects and processes this personal data in accordance with the terms and principles described in this Privacy Statement.
5. Consent
By visiting and using the Site, the user declares that they have read the Privacy Statement and have given their free, specific, informed, and unambiguous consent to the processing of their personal data as described in this Privacy Statement.
Consent is given through the positive and active action by which the user checks the box for the Privacy Statement in a hypertext link. This consent is essential for performing certain actions on the Site or enabling the user to enter into a contractual relationship with Element X. Any agreement between Element X and a user regarding the services and goods offered on the Site is subject to the user’s acceptance of this Privacy Statement.
The user agrees that the Data Controller may collect and process their personal data, provided on the Site or in connection with the services offered by Element X, for the purposes described above.
The user has the right to withdraw their consent at any time. The withdrawal of consent does not affect the lawfulness of processing based on consent previously given.
6. Retention period of users’ personal data
In accordance with Article 13(2) of the Regulation, the Data Controller retains personal data only as long as reasonably necessary to achieve the purposes for which it is processed. This period is never longer than necessary for the purposes for which we collect your personal data, unless a legal obligation requires us to retain your data for a longer period.
7. Recipients of data and disclosure to third parties
Personal data may be transferred to employees, staff, subcontractors, processors, or suppliers of Element X, provided that adequate safeguards are in place to ensure data security and that they cooperate with Element X in marketing the products or delivering services. They act under the direct responsibility of Element X and are accountable for collecting, processing, or outsourcing this data.
In all cases, recipients of the data and those to whom the data is provided must comply with the contents of this Privacy Statement. Element X ensures that they process this data solely for the intended purposes and in a discreet and secure manner.
If data is shared with third parties for direct marketing or prospecting purposes, the user will be informed in advance so that explicit consent can be given for the use of their personal data.
8. Users’ rights

A. Right of access
In accordance with Article 15 of the Regulation, Element X guarantees the right of access to personal data for the user. The user has the right to access their personal data and the following information:
The categories of personal data concerned;
The recipients or categories of recipients to whom the personal data is disclosed;
If the recipients are located in third countries or international organizations, the appropriate safeguards;
Where possible, the proposed retention period for personal data or, if not possible, the criteria used to determine this period;
The existence of automated decision-making, including profiling, and, where applicable, meaningful information about the underlying logic and the consequences for the data subject.
The Data Controller may charge a reasonable fee based on administrative costs for additional copies requested by the user.
When the user submits a request electronically, the data will be provided in a commonly used electronic format, unless otherwise requested.
A copy of the data will be provided no later than one month after receipt of the request.
B. Right to rectification
Element X guarantees the user’s right to correct or delete inaccurate, incomplete, or irrelevant data in accordance with Article 16 of the Regulation. Users can make changes themselves via their user account or, if this is not possible, submit a request to Element X.
Element X informs all recipients of the personal data about the corrections made, unless this proves impossible or requires disproportionate effort.
C. Right to erasure
The user has the right to request that their personal data be erased as soon as possible in the cases referred to in Article 17 of the Regulation.
If the Data Controller has made personal data public and is obliged to erase it, Element X takes reasonable steps to inform other processors about the request for erasure.
The obligation to erase does not apply if the processing is necessary:
For the exercise of the right to freedom of expression and information;
To comply with a legal obligation;
For the establishment, exercise, or defense of legal claims.
D. Right to restriction of processing
Users have the right to restrict the processing of their personal data in the cases referred to in Article 18 of the Regulation. Element X informs all recipients of the data about the restriction of processing, unless this proves impossible or requires disproportionate effort.
E. Right to data portability
In accordance with Article 20 of the Regulation, users have the right to receive their personal data in a structured, commonly used, and machine-readable format and to transfer it to another data controller. This right does not affect the right to erasure and does not apply if the processing is necessary for a task carried out in the public interest.
F. Right to object and automated individual decision-making
Users have the right to object at any time to the processing of their personal data, including automated decision-making. Element X will cease processing unless there are compelling legitimate grounds that override the user’s interests or for the establishment, exercise, or defense of legal claims. When processing for prospecting purposes, users always have the right to object, after which the data will no longer be processed for that purpose.
9. Right to lodge a complaint
The user has the right to lodge a complaint regarding the processing of their personal data by Element X with the data protection authority competent for Belgian territory. More information can be found on the website: https://www.gegevensbeschermingsautoriteit.be

The user may also file a claim for cessation with the presiding judge of the court of first instance in their place of residence.
10. Limitation of liability of the data controller
The website may contain links to third-party websites that are not affiliated with Element X. The content of these sites and their compliance with the Regulation and the Law are not the responsibility of Element X. For minors under the age of 16, explicit consent must be given by their legal representative to share personal data via the Site. Element X strongly encourages guardians to promote responsible and safe internet use. The Data Controller cannot be held liable for the collection and processing of personal data from minors under 16 without effective consent from their legal representatives, nor for inaccurate data, particularly regarding age, provided by minors. Under no circumstances will personal data be processed by the Data Controller if the user indicates they are under 16.
Element X is not responsible for the loss, damage, or theft of personal data, particularly as a result of viruses or computer attacks.
11. Security measures
The Data Controller implements technical and organizational measures to ensure an appropriate level of security for the processing and collection of data. These security measures are balanced against implementation costs in relation to the nature, context, and purposes of personal data processing.
During the transfer or collection of data on the Site, the data controller uses standard encryption technologies commonly used in the IT sector.
12. Changes to the Privacy Statement
Element X reserves the right to amend this Privacy Statement to comply with legal obligations. Users are therefore advised to review the Privacy Statement regularly to stay informed of changes and updates. Such changes will be posted on the Site or sent by email to ensure they are binding.
13. Applicable law and competent court
This privacy statement is exclusively governed by Belgian law. Any dispute will be submitted to the courts of the judicial district where the registered office of Element X is located.
